Mark Terms of Use
Mark is free and your photos are yours. These terms explain how you may use it, how brand marks are treated, and who is responsible for what if something goes wrong.
1. Accepting these terms
These terms are the agreement between you and Lenscript (光子方程), an independent developer team ("we", "us"), for Mark's web, desktop, Android and command-line versions ("Mark"). By using Mark you confirm that you have read and agree to these terms and the privacy policy. If you do not agree, please do not use it.
2. Free use and tips
Every feature of Mark is free and needs no sign-up. Tipping is entirely voluntary, unlocks nothing and is not a purchase. Tips are collected by the payment platform you choose; a tip is a voluntary gift and is not returned, except where the law requires otherwise.
3. Software licence
Provided you comply with these terms, you may install and use Mark on your own devices for personal and commercial purposes. Mark's rendering engine grew out of the Apache-2.0 licensed open-source project Semi-Utils; bundled third-party components (fonts, the HEIC decoder and others) are provided under their own licences, listed in the licence and notice files shipped with the software.
You must not: publish modified builds that pass themselves off as Mark or as ours; remove copyright and licence notices from the software; or use Mark for unlawful purposes or to interfere with our servers.
4. Your photos and exports
Your photos and exports remain yours, and Mark never uploads them. Before exporting, check that the settings and brand in the watermark are right and that location data has been removed as you need (see "Location data on export" in the privacy policy); automatic detection can be wrong, and your check is what counts.
5. Camera brand marks
The camera and lens brand marks built into Mark (such as Sony, Nikon, Canon, FUJIFILM and Leica) belong to their owners and are used only to show which equipment took a photo. Mark is not affiliated with, sponsored by or endorsed by any of them. Before using work that carries a brand mark in advertising, check whether you need the owner's permission.
6. Disclaimer
Mark is provided "as is". To the fullest extent permitted by law we do not warrant that the service will be uninterrupted or error-free, or that it will meet your particular needs.
We work to fix defects and keep the service stable, but as a small independent team we cannot promise a specific service level or turnaround time.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, consequential or special loss, loss of profit or loss of data arising from your use of, or inability to use, Mark.
Our total liability to you for all claims, however arising, is limited to the amount you paid us for Mark in the 12 months before the event giving rise to the claim, or, if you have paid nothing, to CNY 100.
Nothing in this section excludes or limits liability that cannot be excluded or limited by law, such as liability for wilful misconduct or gross negligence.
8. Changes to these terms
We may update these terms when the product, the law or our commercial arrangements change. The current version is always published at https://lenscript.cn/en/mark/terms/, with the version number and effective date at the top updated accordingly.
For changes that materially affect your rights or obligations (pricing structure, content licence) we give at least 14 days' notice on this page, in the app or by email to the address you gave us. Continuing to use the service after a change takes effect means you accept it. If you do not agree, stop using the service before the effective date.
9. Governing law and disputes
These terms are governed by the laws of the People's Republic of China (excluding Hong Kong, Macao and Taiwan, and excluding conflict-of-law rules).
Disputes arising from these terms should first be raised with us so that we can try to resolve them amicably; failing that, either party may bring the matter before the competent People's Court at the place where the operator of Lenscript (光子方程) is located.
If the law of your place of residence grants you consumer rights that cannot be waived, nothing in these terms reduces those rights.
